{"id":30458,"date":"2022-08-15T15:15:59","date_gmt":"2022-08-15T13:15:59","guid":{"rendered":"https:\/\/www.apiagentura.gov.cz\/?page_id=30458"},"modified":"2025-09-26T11:45:19","modified_gmt":"2025-09-26T09:45:19","slug":"uspory-energie-vyzva-i","status":"publish","type":"page","link":"https:\/\/apiagentura.gov.cz\/cs\/podporovane-aktivity-optak\/uspory-energie-optak\/uspory-energie-vyzva-i\/","title":{"rendered":"\u00daspory energie &#8211; v\u00fdzva I"},"content":{"rendered":"<p><\/p>\n<h3>Informace pro \u017eadatele a p\u0159\u00edjemce<\/h3>\n<p><strong>26. 9. 2025: Ministerstvo pr\u016fmyslu a obchodu informovalo o zm\u011bn\u011b<\/strong><strong> textu Pravidel pro \u017eadatele a p\u0159\u00edjemce z OP TAK \u2013 zvl\u00e1\u0161tn\u00ed \u010d\u00e1st v\u00fdzvy \u00daspory energie \u2013 v\u00fdzva I.<\/strong><\/p>\n<p>Poskytovatel dotace na z\u00e1klad\u011b prob\u011bhl\u00fdch audit\u016f a p\u0159ipom\u00ednek Evropsk\u00e9 komise, kter\u00e9 se t\u00fdkaj\u00ed OP TAK \u00daspory energie a posouzen\u00ed ro\u010dn\u00ed produkce v\u00fdrobn\u00edho za\u0159\u00edzen\u00ed (nahrazovan\u00e9 za\u0159\u00edzen\u00ed x po\u0159izovan\u00e9 za\u0159\u00edzen\u00ed) v r\u00e1mci \u00daspory energie \u2013 I. v\u00fdzva, byly na z\u00e1klad\u011b v\u00fdstup\u016f, zji\u0161t\u011bn\u00fdch nedostatk\u016f syst\u00e9mov\u00e9ho charakteru a podn\u011bt\u016f z jednotliv\u00fdch prov\u00e1d\u011bn\u00fdch audit\u016f operac\u00ed vypracov\u00e1na n\u00e1pravn\u00e1 opat\u0159en\u00ed, kter\u00e1 byla zapracov\u00e1na do Pravidel pro \u017eadatele a p\u0159\u00edjemce \u2013 zvl\u00e1\u0161tn\u00ed \u010d\u00e1st.<\/p>\n<p>V r\u00e1mci kapitoly 5.2 Specifick\u00e9 p\u0159\u00edlohy k ZoU\/ZZoU byly specifikov\u00e1ny dokumenty, kter\u00e9 mus\u00ed p\u0159\u00edjemci dotace dolo\u017eit ke Zpr\u00e1v\u00e1m o udr\u017eitelnosti ve vztahu na kontrolu pln\u011bn\u00ed specifick\u00e9 podm\u00ednky programu podle P\u0159\u00edlohy \u010d. 3.a, bod t), tj. posouzen\u00ed ro\u010dn\u00ed produkce v\u00fdrobn\u00edho za\u0159\u00edzen\u00ed (nahrazovan\u00e9 za\u0159\u00edzen\u00ed x po\u0159izovan\u00e9 za\u0159\u00edzen\u00ed). Jedn\u00e1 se o podklady prokazuj\u00edc\u00ed stanoven\u00ed ro\u010dn\u00ed produkce p\u016fvodn\u00edch (nahrazovan\u00fdch) za\u0159\u00edzen\u00ed, kterou p\u0159\u00edjemce stanovil v r\u00e1mci \u017e\u00e1dosti o podporu anebo p\u0159\u00edloh\u00e1ch a d\u00e1le \u00fadaje o ro\u010dn\u00ed produkci nov\u00fdch za\u0159\u00edzen\u00ed v\u010detn\u011b podklad\u016f k prok\u00e1z\u00e1n\u00ed tohoto \u00fadaje (podrobn\u011b viz Pravidla pro \u017eadatele a p\u0159\u00edjemce zvl\u00e1\u0161tn\u00ed \u010d\u00e1st).<\/p>\n<p>Jedn\u00e1 o zp\u0159es\u0148uj\u00edc\u00ed v\u00fdklad podm\u00ednky P\u0159\u00edlohy \u010d. 3.a V\u00fdzvy, bodu t), tud\u00ed\u017e se po\u017eadavek vztahuje na v\u0161echny projekty s\u00a0vydan\u00fdm Rozhodnut\u00edm o poskytnut\u00ed dotace, kter\u00e9 obsahuj\u00ed aktivitu \u201eSni\u017eov\u00e1n\u00ed energetick\u00e9 n\u00e1ro\u010dnosti\/zvy\u0161ov\u00e1n\u00ed energetick\u00e9 \u00fa\u010dinnosti v\u00fdrobn\u00edch a technologick\u00fdch proces\u016f\u201c.<\/p>\n<p><strong><em>Zm\u011bny jsou platn\u00e9 od 26.9.2025<\/em><\/strong><em>.<\/em><\/p>\n<p><strong>10. 11. 2023:\u00a0 Ministerstvo pr\u016fmyslu a obchodu informovalo o z<\/strong><strong>m\u011bn\u011b textu v\u00fdzvy \u00daspory energie \u2013 v\u00fdzva I.<\/strong><\/p>\n<p style=\"text-align: justify;\">Poskytovatel dotace se rozhodl, \u017ee k vyd\u00e1n\u00ed Rozhodnut\u00ed o poskytnut\u00ed dotace (ROPD) nebude t\u0159eba dokl\u00e1dat \u00fazemn\u00ed rozhodnut\u00ed\/stavebn\u00ed povolen\u00ed\/spole\u010dn\u00e9 \u00fazemn\u00ed a stavebn\u00ed rozhodnut\u00ed s\u00a0vyzna\u010den\u00edm pr\u00e1vn\u00ed moci\/\u00fa\u010dinnou ve\u0159ejnopr\u00e1vn\u00ed smlouvu\/certifik\u00e1t vydan\u00fd autorizovan\u00fdm inspektorem\/sd\u011blen\u00ed \u00fa\u0159adu, \u017ee projekt nepodl\u00e9h\u00e1 \u00fazemn\u00edmu\/stavebn\u00edmu \u0159\u00edzen\u00ed (d\u00e1le jen \u201evyj\u00e1d\u0159en\u00ed stavebn\u00edho \u00fa\u0159adu), jak je uvedeno v\u00a0podm\u00ednk\u00e1ch V\u00fdzvy. Podm\u00ednka kap. 8.2 p\u00edsmene a) byla tud\u00ed\u017e z\u00a0V\u00fdzvy vymaz\u00e1na.<\/p>\n<p style=\"text-align: justify;\">Podm\u00ednka dolo\u017een\u00ed vyj\u00e1d\u0159en\u00ed stavebn\u00edho \u00fa\u0159adu byla nov\u011b zapracov\u00e1na do vzoru Rozhodnut\u00ed o poskytnut\u00ed dotace (p\u0159\u00edloha \u010d. 7 V\u00fdzvy, bod 6.13.12). Pro dolo\u017een\u00ed vyj\u00e1d\u0159en\u00ed stavebn\u00edho \u00fa\u0159adu i nad\u00e1le plat\u00ed lh\u016fta 270 dn\u016f od syst\u00e9mov\u00e9 depe\u0161e v\u00a0MS2021+ s\u00a0informac\u00ed o tom, \u017ee \u017e\u00e1dost o podporu byla doporu\u010dena k\u00a0financov\u00e1n\u00ed (stav PP25a nebo stav PP25b nebo stav PU25 \u2013 \u017e\u00e1dost o podporu za\u0159azena mezi n\u00e1hradn\u00ed projekty).<\/p>\n<p style=\"text-align: justify;\">V\u0161echny ostatn\u00ed podm\u00ednky kap. 8.2 z\u016fst\u00e1vaj\u00ed zachov\u00e1ny, stejn\u011b jako povinnost dolo\u017een\u00ed \u010destn\u00e9ho prohl\u00e1\u0161en\u00ed k RoPD. Z\u00a0povinnost\u00ed kap. 8.2 se jedn\u00e1 zejm\u00e9na o povinnost dolo\u017eit dokumenty k\u00a0jednozna\u010dn\u00e9mu prok\u00e1z\u00e1n\u00ed pr\u00e1v k\u00a0m\u00edstu realizace, prohl\u00e1\u0161en\u00ed k\u00a0velikosti podniku a v\u00a0relevantn\u00edch p\u0159\u00edpadech formul\u00e1\u0159 pro posouzen\u00ed podniku v\u00a0obt\u00ed\u017e\u00edch a prohl\u00e1\u0161en\u00ed k\u00a0de minimis (d\u00e1le viz po\u017eadavky kap. 8.2). Tyto dokumenty je nutn\u00e9 dolo\u017eit nejpozd\u011bji do 30. 11. 2023. V p\u0159\u00edpad\u011b nedolo\u017een\u00ed povinn\u00fdch p\u0159\u00edloh pro vyd\u00e1n\u00ed ROPD v uveden\u00e9m term\u00ednu bude \u017eadatel vystaven riziku, \u017ee se procesn\u011b nestihne ROPD vydat do 31.12.2023 a poskytovatel dotace bude nucen aktualizovat na projektu podm\u00ednky podle nov\u011b platn\u00e9ho Na\u0159\u00edzen\u00ed Komise (EU) \u010d. 651\/2014, obecn\u00e9 na\u0159\u00edzen\u00ed o blokov\u00fdch v\u00fdjimk\u00e1ch \u2013 konsolidovan\u00e9 zn\u011bn\u00ed \u00fa\u010dinn\u00e9 ke dni 1.7.2023 (d\u00e1le jen \u201eGBER\u201c).<\/p>\n<p style=\"text-align: justify;\">Kontrola velikosti podniku bude nov\u011b ze strany poskytovatele dotace prob\u00edhat po vyd\u00e1n\u00ed ROPD. Z\u00a0Modelu hodnocen\u00ed (p\u0159\u00edloha \u010d. 1 V\u00fdzvy) byla tud\u00ed\u017e vymaz\u00e1na povinnost poskytovatele dotace prov\u00e9st kontrolu velikosti podniku p\u0159ed vyd\u00e1n\u00edm RoPD.<\/p>\n<p style=\"text-align: justify;\">K t\u00e9to zm\u011bn\u011b poskytovatel dotace p\u0159istoupil v\u00a0d\u016fsledku zve\u0159ejn\u011bn\u00ed zm\u011bnov\u00e9ho na\u0159\u00edzen\u00ed GBERu &#8211; Na\u0159\u00edzen\u00ed Komise (EU) 2023\/1315 ze dne 23. \u010dervna 2023, o zm\u011bn\u011b na\u0159\u00edzen\u00ed (EU) \u010d. 651\/2014, kter\u00fdm se v souladu s \u010dl\u00e1nky 107 a 108 Smlouvy prohla\u0161uj\u00ed ur\u010dit\u00e9 kategorie podpory za slu\u010diteln\u00e9 s vnit\u0159n\u00edm trhem, a na\u0159\u00edzen\u00ed (EU) 2022\/2473, kter\u00fdm se ur\u010dit\u00e9 kategorie podpory pro podniky p\u016fsob\u00edc\u00ed v oblasti produkce, zpracov\u00e1n\u00ed a uv\u00e1d\u011bn\u00ed produkt\u016f rybolovu a akvakultury na trh prohla\u0161uj\u00ed za slu\u010diteln\u00e9 s vnit\u0159n\u00edm trhem podle \u010dl\u00e1nk\u016f 107 a 108 Smlouvy.\u00a0Nov\u00e9 zn\u011bn\u00ed v\u00fdrazn\u011b m\u011bn\u00ed \u010dl\u00e1nek 38, na z\u00e1klad\u011b kter\u00e9ho, je poskytov\u00e1na podpora v\u00a0r\u00e1mci dan\u00e9 V\u00fdzvy.<\/p>\n<p style=\"text-align: justify;\">V\u00fd\u0161e uveden\u00e1 opat\u0159en\u00ed maj\u00ed napomoci k tomu, aby poskytovatel dotace zachoval co nejv\u011bt\u0161\u00edmu po\u010dtu projekt\u016f p\u016fvodn\u00ed podm\u00ednky v\u00fdzvy. Projekt\u016fm, kter\u00fdm nebude vyd\u00e1no ROPD do konce roku 2023, budou muset b\u00fdt podm\u00ednky upraveny podle nov\u00e9ho zn\u011bn\u00ed GBER.<\/p>\n<p style=\"text-align: justify;\">Dal\u0161\u00edmi zm\u011bnami v\u00fdzvy je dopln\u011bn\u00ed do kapitoly s n\u00e1zvem \u201eOstatn\u00ed ustanoven\u00ed\u201c od\u016fvodn\u011bn\u00ed zac\u00edlen\u00ed v\u00fdzvy v souladu s po\u017eadavkem MP VHVP kapitolou 4.1.5 a dopln\u011bn\u00ed kapitoly s n\u00e1zvem \u201eP\u0159\u00edlohy a navazuj\u00edc\u00ed dokumentace k V\u00fdzv\u011b\u201c o p\u0159\u00edlohu \u010d. 9 s n\u00e1zvem \u201eNepodporovan\u00e9 kategorie CZ NACE\u201c, kter\u00e1 byla dodate\u010dn\u011b zve\u0159ejn\u011bna dne 5. 5. 2023, ale nebyla k dan\u00e9mu dni dops\u00e1na do seznamu p\u0159\u00edloh v\u00fdzvy.<\/p>\n<p><strong>28. 7. 2023:\u00a0<\/strong><strong><span style=\"color: #ff0000;\">P\u0159ed\u010dasn\u00e9 ukon\u010den\u00ed p\u0159\u00edjmu<\/span> <span style=\"color: #ff0000;\">\u017e\u00e1dost\u00ed<\/span> ve v\u00fdzv\u011b I. v\u00a0aktivit\u011b \u00daspory energie<\/strong><\/p>\n<p style=\"text-align: justify;\">\u0158\u00eddic\u00ed org\u00e1n Ministerstvo pr\u016fmyslu a obchodu <strong>mus\u00ed reagovat na v\u00fdznamn\u00e9 zm\u011bny<\/strong> v\u00a0podm\u00ednk\u00e1ch ve\u0159ejn\u00e9 podpory stanoven\u00e9 aktualizovan\u00fdm zn\u011bn\u00edm <strong>GBER<\/strong> (na\u0159\u00edzen\u00ed (EU) \u010d. 651\/2014) <strong>vze\u0161l\u00e9 v\u00a0platnost 30. 6. 2023<\/strong>. Podm\u00ednky aktualizovan\u00e9ho GBER jsou natolik rozd\u00edln\u00e9 od p\u016fvodn\u00edch, \u017ee na n\u011b nen\u00ed mo\u017en\u00e9 reagovat jinak ne\u017e <strong>p\u0159ed\u010dasn\u011b ukon\u010dit p\u0159\u00edjem \u017e\u00e1dost\u00ed ve v\u00fdzv\u011b I. pro aktivitu \u00daspory energie<\/strong>. V\u00fdzva bude p\u0159epracov\u00e1na tak, aby nov\u00e9 nastaven\u00ed odpov\u00eddalo po\u017eadavk\u016fm revidovan\u00e9ho na\u0159\u00edzen\u00ed GBER, a to na z\u00e1klad\u011b ji\u017e zah\u00e1jen\u00fdch konzultac\u00ed s\u00a0poradn\u00edm org\u00e1nem Evropsk\u00e9 komise. D\u00e1le upozor\u0148ujeme \u017eadatele, kte\u0159\u00ed hodlaj\u00ed podat \u017e\u00e1dost do v\u00fdzvy I. v aktivit\u011b \u00daspory energie p\u0159ed ukon\u010den\u00edm jejich p\u0159\u00edjmu, \u017ee <strong>\u0158\u00eddic\u00ed org\u00e1n mus\u00ed vydat v\u0161echna Rozhodnut\u00ed o poskytnut\u00ed dotace<\/strong> (d\u00e1le \u201eRoPD\u201c) <strong>nejpozd\u011bji do 31. 12. 2023<\/strong>, nebo\u0165 po tomto datu ji\u017e lze vyd\u00e1vat RoPD v\u00fdhradn\u011b podle nov\u00e9ho zn\u011bn\u00ed GBER, s\u00a0n\u00edm\u017e v\u0161ak v\u00fdzva I. bohu\u017eel nen\u00ed (a nem\u016f\u017ee b\u00fdt) v\u00a0souladu. Pokud je tedy z\u0159ejm\u00e9, \u017ee pl\u00e1novan\u00fd projekt nez\u00edsk\u00e1 ve\u0161ker\u00e9 podklady k\u00a0vyd\u00e1n\u00ed RoPD (nap\u0159\u00edklad stavebn\u00ed povolen\u00ed) do 30. 11. 2023, doporu\u010dujeme takov\u00fd projekt v\u016fbec neregistrovat a vy\u010dkat s\u00a0jeho pod\u00e1n\u00edm na novou v\u00fdzvu.<\/p>\n<p style=\"text-align: justify;\">Oznamujeme proto t\u00edmto, \u017ee <strong>p\u0159\u00edjem \u017e\u00e1dost\u00ed do v\u00fdzvy I. v aktivit\u011b \u00daspory energie OP TAK bude ukon\u010den <span style=\"color: #ff0000;\">31. 8. 2023 ve 12:00<\/span><\/strong>. Nov\u00e1 v\u00fdzva s upraven\u00fdmi podm\u00ednkami pak bude op\u011btovn\u011b vyhl\u00e1\u0161ena v z\u00e1vislosti na d\u00e9lce nezbytn\u00fdch proces\u016f spojen\u00fdch s vyjasn\u011bn\u00edm p\u0159\u00edslu\u0161n\u00fdch \u010dl\u00e1nk\u016f nov\u00e9ho GBER. Pl\u00e1novan\u00fd term\u00edn je p\u0159elom roku 2023\/2024.<\/p>\n<hr \/>\n<p><strong>5. 5. 2023:<\/strong> Dne 5. 5. 2023 MPO informovalo o dodate\u010dn\u00e9m zve\u0159ejn\u011bn\u00ed p\u0159\u00edlohy <strong>\u010d. 9 &#8211; Nepodporovan\u00e9 CZ NACE<\/strong> u v\u00fdzvy I \u00daspory energie.<\/p>\n<p>Obsah p\u0159\u00edlohy zohled\u0148uje po\u017eadavky \u010dl\u00e1nku 7 odst. 1 NA\u0158\u00cdZEN\u00cd EVROPSK\u00c9HO PARLAMENTU A RADY (EU) 2021\/1058 ze dne 24. \u010dervna 2021 o Evropsk\u00e9m fondu pro region\u00e1ln\u00ed rozvoj a o Fondu soudr\u017enosti a NA\u0158\u00cdZEN\u00cd KOMISE (EU) \u010d. 651\/2014 ze dne 17. \u010dervna 2014, kter\u00fdm se v souladu s \u010dl\u00e1nky 107 a 108 Smlouvy prohla\u0161uj\u00ed ur\u010dit\u00e9 kategorie podpory za slu\u010diteln\u00e9 s vnit\u0159n\u00edm trhem (GBER). Jedn\u00e1 se tedy o povinnosti, kter\u00e9 plynou p\u0159\u00edmo z\u00a0uveden\u00fdch na\u0159\u00edzen\u00ed.<\/p>\n<p>V\u00a0r\u00e1mci ji\u017e podan\u00fdch projekt\u016f bylo ov\u011b\u0159eno, \u017ee z\u00a0hlediska CZ NACE spl\u0148uj\u00ed projekty po\u017eadavky na\u0159\u00edzen\u00ed, resp. p\u0159\u00edlohy.<\/p>\n<p><strong>24. 2. 2023:<\/strong> Dne 24. 2. 2023 MPO informovalo o zm\u011bn\u011b textu I. v\u00fdzvy \u00daspory energie a <strong>p\u0159\u00edlohy \u010d. 1 Model hodnocen\u00ed<\/strong> (\u00faprava krit\u00e9ria v\u011bcn\u00e9ho hodnocen\u00ed \u010d. 9 \u201eHospod\u00e1rnost rozpo\u010dtu\u201c), <strong>\u010d. 3 Specifick\u00e9 podm\u00ednky v\u00fdzvy<\/strong> (podm\u00ednka h)) a <strong>\u010d. 4 Posudek pln\u011bn\u00ed DNSH a klimatick\u00e9ho dopadu<\/strong> (\u010d\u00e1st I., str. 3\u20134).<\/p>\n<p>V\u00a0textu V\u00fdzvy do\u0161lo k\u00a0\u00faprav\u011b definice nepodporovan\u00e9 aktivity \u201eSni\u017eov\u00e1n\u00ed energetick\u00e9 n\u00e1ro\u010dnosti\/zvy\u0161ov\u00e1n\u00ed energetick\u00e9 \u00fa\u010dinnosti v\u00fdrobn\u00edch a technologick\u00fdch proces\u016f\u201c, tak, aby byla zamezena podpora projekt\u016f s fiktivn\u00ed \u00fasporou energie; d\u00e1le k \u00faprav\u011b pom\u011br\u016f velikosti akumulace k velikosti FVE 1:1 a dopln\u011bn\u00ed odkazu na zp\u0159esn\u011bn\u00ed definice indik\u00e1tor\u016f (form\u00e1ln\u00ed \u00faprava).<\/p>\n<p>V\u0161echny v\u00fd\u0161e uveden\u00e9 zm\u011bny jsou formou reviz\u00ed zve\u0159ejn\u011bny v\u00a0n\u00ed\u017ee uveden\u00fdch dokumentech.<\/p>\n<p><strong>Platnost v\u0161ech upraven\u00fdch podm\u00ednek<\/strong> je stanovena ode dne<strong> 10. 3. 2023<\/strong>. V\u00fd\u0161e uveden\u00e9 zm\u011bny V\u00fdzvy a p\u0159\u00edloh V\u00fdzvy se nevztahuj\u00ed na \u017e\u00e1dosti o podporu, kter\u00e9 ji\u017e byly \u017eadateli pod\u00e1ny.
